The inclusion of Vietnam in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) Agreement has commenced.

Vietnam joins the other current CPTPP signatory countries:  Australia, Canada, Japan, Mexico, New Zealand and Singapore.

Brunei Darussalam, Chile, Malaysia and Peru are also expected to join the agreement 60 days after they complete their respective ratification processes.

Legislative Instrument – F2018L01479 –  LIN 18/183: Determination of International Trade Obligations relating to Labour Market Testing 2018, lists the CPTPP as an agreement for the purposes of paragraph 140GBA(1)(c) of the Act. 

Paragraph 140GBA(1)(c) provides that the labour market testing condition in section 140GBA does not apply to a nomination by an approved sponsor, if it would be inconsistent with any international trade obligation of Australia.

Vietnam’s inclusion in the CPTPP came into effect last 14 January 2019.
