Migration Law Updates (MLU) reported today that a Federal Court decision ruled that the AAT had the discretion to accept an application lodged after the 21-day application deadline, setting an important precedent.

Unless overturned, this precedent could have major impacts on applicants who may have chosen not to make application to the AAT as they had missed the time limit, and applicants whose applications the AAT has said they have no jurisdiction to review due to missing the statutory time limit.
